Public offer for the AVALANCHE Service

1. Document status and definitions

1.1. This document is a public offer (“Terms”) containing essential conditions for paid access to the AVALANCHE VPN service (“Service”).

1.2. “AVALANCHE” is the commercial designation of the Service; “Provider” means the party that delivers the Service under that designation (legal entity details — in the Legal details section at the bottom of this page). “User” — a capable individual who accepts the Terms. “Subscription” — a paid access period under a selected plan. “Dashboard” — the secured account area on the website.

1.3. The Privacy Policy published on the site is an integral part of these Terms.

2. Subject matter

2.1. The Provider grants access to a VPN system: encrypted traffic between the User’s device and the Provider’s servers, client apps on supported platforms, and dashboard features within the paid plan.

2.2. Plan parameters (devices, traffic caps, other limits) are those disclosed in the dashboard before payment.

2.3. The Provider may update software, protocols, and server configuration without separate consent if the paid plan’s essential characteristics are not materially reduced for the paid period.

3. Acceptance

3.1. Acceptance occurs by account registration, use of the Service, or payment.

3.2. The User confirms they are at least eighteen (18) years old, legally capable, and has read these Terms and the Privacy Policy.

3.3. If the User disagrees, they must not use the Service.

4. Price, payment, and balance

4.1. Plans and prices are in the dashboard. Price is fixed for the period paid.

4.2. Payments are processed by integrated payment providers; full card data is not stored by the Provider.

4.3. Funds may be credited to an internal balance and used for Subscription payment, including auto-renewal if enabled. Balance is prepaid service credit, not a deposit or e-money.

4.4. Auto-renewal charges at the end of the current paid period (or as stated in the dashboard) at the plan price effective on the charge date, unless a promotion or plan locked a different rule at first payment.

4.5. Auto-renewal may be disabled anytime in the dashboard; the current paid period continues until it ends.

5. Trial access

5.1. After email verification, a one-time trial may be offered under dashboard terms, typically without payment details and without automatic conversion to paid Subscription.

6. Refunds

6.1. Within seven (7) calendar days of the first paid Subscription payment on an account, the User may request a full refund of that first payment without stating a reason.

6.2. After seven (7) days, refunds for unused periods require material unavailability or malfunction due to the Provider’s fault, a support ticket, and failure to remedy within a reasonable time.

6.3. Requests from the registered email to the support contacts at the bottom of this page, with payment details.

6.4. Refunds to the original payment method within ten (10) business days after approval; bank timing may vary.

6.5. Bonuses, promo credits, and trial value are non-refundable.

6.6. The Provider may suspend access during chargeback disputes pending resolution.

7. User obligations and prohibited use

7.1. The User must use the Service lawfully, keep credentials confidential, respect plan limits, and assess legality of their internet use in their jurisdiction.

7.2. Prohibited: unlawful activity; spam; malware/phishing; unauthorized access, DDoS, scanning, or attacks on third-party networks; reselling or sharing access beyond plan device limits; excessive load on infrastructure.

7.3. Violations may result in restriction or termination; authorities may be contacted where required by law.

8. Provider obligations

8.1. Provide technical access within the paid plan and maintain instructions in the dashboard and help center.

8.2. Maintenance or suspension may occur with or without notice when necessary for security and stability.

9. Warranties and disclaimers

9.1. The Service is provided “as is”. No guarantee of uninterrupted operation, specific speed, specific locations, access to particular third-party sites/services, or bypass of blocks or filters imposed by third parties.

9.2. Performance depends on networks, ISPs, third parties, and User equipment.

10. Intellectual property

10.1. Software, branding, and materials belong to the Provider or licensors.

10.2. A limited non-exclusive non-transferable license for personal use during paid Subscription. No reverse engineering, circumvention, or unauthorized resale.

11. Liability

11.1. Aggregate Provider liability is limited to amounts paid for the last paid Subscription period, unless mandatory law forbids such limitation.

11.2. No liability for third parties, ISPs, User equipment, or force majeure.

12. Personal data

12.1. Processed under the Privacy Policy.

13. Changes to Terms

13.1. Terms remain in effect until withdrawn.

13.2. Updates are published with effective date.

13.3. Material changes (refunds, auto-renewal, plan limits) take effect no sooner than ten (10) calendar days after publication unless stated otherwise; notice by email and/or dashboard.

13.4. Already paid periods remain under Terms effective at payment unless mandatory law requires otherwise.

13.5. Continued use after changes constitutes acceptance; the User may stop using the Service and delete the account if they disagree.

14. Termination

14.1. The User may delete the account via dashboard or support.

14.2. The Provider may terminate access for material breach, after unpaid period end, or as otherwise permitted.

15. Disputes and governing law

15.1. Disputes first by negotiation; complaints to support@avalanche.vu, response within thirty (30) calendar days.

15.2. Law of the Kyrgyz Republic, subject to mandatory consumer protections in the User’s country if applicable.

15.3. Courts at the Provider’s location unless mandatory law provides otherwise.
